INTRODUCTION
The following Terms and Conditions (Ts & Cs) constitute a binding contract between You and KRSTL Aligners (PTY) LTD. By placing an order with us, you agree to be bound by these accordingly.
BECOMING A KRSTL PROVIDER
To become a KRSTL Provider, kindly download the KRSTL Provider Registration Form, complete and submit to admin@krstl.co.za.
THE KRSTL TREATMENT PROCESS
1. Create Patient on the KRSTL Portal with clear instructions for treatment planning including all relevant data. Alternatively submit STL Scans / Impressions and the KRSTL Case Submission Form.
2. Receive 3D Planning Viewer and consult with Patient.
3. Manufacturing of KRSTL Aligners.
4. Delivery
CASE SUBMISSIONS
Please ensure that you have informed your Patient of the upfront KRSTL Treatment Planning fee to be paid in order for the planning process to be initiated.
TREATMENT SETUPS
KRSTL Aligners manufactures custom orthodontic devices (“Appliances”) designed to adjust or retain the position of a Patient’s teeth based on the Dental Practitioner’s prescription.
If your prescription requires the movement of teeth, we will generate a 3D representation accordingly for your approval.
ORDERS AND PAYMENTS
Upon your approval of a KRSTL Treatment Plan, followed by the selection of an appropriate KRSTL Package, full payment will be required as per the selected package in order to secure / complete your KRSTL order.
KRSTL PACKAGES
We offer a selection of KRSTL Package Options for either single or dual arch plans.
- KRSTL CREATE 8: Up to 8 Stages
- KRSTL 14 DESIGN: Up to 14 Stages
- KRSTL 24 PLUS: Up to 24 Stages
- KRSTL 48 PRO: Up to 48 Stages
- KRSTL RETAIN_IT PACK: 4 KRSTL Retainers
- KRSTL Retainers: KRSTL Retainers can either be based on the plan that you have approved OR based on a submission of new impressions or scans.
- KRSTL Retain-It Pack: 4 Retainers
REVISIONS
If your patient’s teeth do not move as expected, you may request a “revision” for any patient that you have treated with KRSTL Aligners. A new KRSTL Plan will be created based on your instruction and new impressions / scans of the current position. This must be submitted on the KRSTL Portal under Matching.
During KRSTL 8 CREATE treatment, you may request one revision, within six months of the original case submission. The revision plan will be at no additional cost. KRSTL Aligners needed for the revision will be charged for should they not fall within the KRSTL Create 8 stages of aligner / aligners.
During KRSTL 14 DESIGN treatment, you may request two revisions, within one year of the original case submission. The revision plan will be at no additional cost. KRSTL Aligners needed for the revision will be charged for should they not fall within the KRSTL Design 14 stages of aligner / aligners.
During KRSTL 24 PLUS treatment, you may request three revisions, within one year of the original case submission. The revision plan will be at no additional cost. KRSTL Aligners needed for the revision will be charged for should they not fall within the KRSTL Plus 24 stages of aligner / aligners.
During KRSTL 48 PRO treatment, you may request three revisions, within two years of the original case submission. The revision plans will be at no additional cost. KRSTL Aligners needed for the revision will be charged for should they not fall within the KRSTL Pro 48 stages of aligner / aligners.
PRICING
- KRSTL Treatment Planning is to be paid upon receipt of invoicing in order for KRSTL to proceed with the planning process.
- All subsequent treatment phases / batches of aligners are to be paid before production can proceed.
- KRSTL Pay-As-You-Align invoices are to be paid upfront.
- KRSTL Packages and individual prices are inclusive of vat.
- Prices are subject to change. We reserve the right to offer alternative products and pricing at our sole discretion. We are not responsible for any taxes or fees charged by third parties, including foreign transaction fees.
CANCELLATION AND REFUNDS
- All sales are final.
- Once a KRSTL Plan has been approved, and an order is then cancelled for any reason, we will not credit or refund any portion of the fees paid for that order.
RECORDS
For all new Patients, the following records must be provided in a timely manner. The following is to be completed on the KRSTL Portal, or via email to
scans@krstl.co.za:
- Scans or impressions of both arches.
- Photos from multiple angles (full face, smiling, profile, upper & lower occlusal, left & right lateral and front).
Retainers not based on the approved KRSTL Plan:
- For retainers not based on the approved KRSTL Plan, new scans are to be loaded on the KRSTL Portal including clear instructions, or PVS impressions of requested arches are needed.
- All records must accurately represent the current condition of the Patient’s teeth.
- You, the Dental Practitioner, are solely responsible for the accuracy of the records you provide and for maintaining them.
- Distorted or incomplete scans and impressions may impact the fit and performance of appliances.
- KRSTL Aligners will not be liable for any issues caused by inaccurate records.
- Aligners or retainers will be charged at standard KRSTL Aligner Pricing if inaccurate impressions or scans are supplied and they do not fit or perform as per the original KRSTL Plan.
Submission Format for Digital X-rays and Photos:
Digital x-rays and photos may only be submitted electronically via the KRSTL Portal, or via email, scans@krstl.co.za, along with a detailed submission form and a signed Patient consent form.
THE FOLLOWING ITEMS WILL NOT BE RETURNED
Treatment Records
Any treatment records submitted electronically, including but not limited to STL files, physical impressions, bite registrations, x-rays, or any other submitted records, may not be returned.
Ownership
All submissions become the property of KRSTL Aligners and will not be returned.
OUR REPRESENTATIONS
You represent and warrant to us that:
- You are licensed to practice dentistry and / or orthodontics in the location(s) where, and at all times during which, treatment is being provided, and you conduct your practice in accordance with all dental laws, regulations and standards of care in effect and applicable to your practice location(s).
- You have all necessary training and expertise to treat Patients using our Products and Appliances.
- Your use of our Products or Appliances will be in accordance with all applicable medical and dental standards and in compliance with our Instructions.
- You have properly explained the products and Appliances to your Patients before starting treatment.
- You have obtained the appropriate Patient consent before starting treatment, including disclosure that You may share their medical records with third parties in order to facilitate treatment at your direction.
WARRANTIES AND DISCLAIMERS
The manufacturers of KRSTL Aligners / Retainers, operates based on the guidance and instruction of dental professionals.
The KRSTL 3D WEBVIEWER software represents a proposed digital planned tooth movement based on the setup and does not reflect actual tooth movements. Tooth movement data should be used as a reference only.
You are solely responsible for prescribing and administering orthodontic treatment and maintaining all Patient medical records. If you gain access to Treatment Planning Services through the KRSTL Plan, then please note that these services shall only be considered as recommendations and that the ultimate decision on whether or not to apply the Treatment Planning Services or to adapt them to the conditions of the specific Patient remains with you as the treating Dental Practitioner.
Neither KRSTL Aligners nor any provider of Treatment Planning Services shall become liable for any damages, claims, liabilities etc. that may result or arise in context with the Treatment Planning Services provided to you.
Clear aligner therapy is unpredictable. We do not guarantee a successful treatment outcome. Individual results will vary.
- Our Products:
- Shall conform to the specifications represented in the treatment setup that you approve.
- Are free from defects in material and workmanship.
- We shall not be liable for defects caused by:
- Neglect, misuse or mistreatment by yourself, the Patient or any third party.
- A Patients’ failure to follow directions eg. wearing aligners out of sequence or for less than the recommended minimum 22 hours per day.
- Alterations or modifications by an individual or entity other than KRSTL Aligners.
- Treatment outcomes when products are being used in combination with third party products.
- Errors in your submitted records or prescriptions.
- Any modifications to these Terms and Conditions can only be made by an authorized representative of KRSTL.
- The limited warranty for each Appliance expires 90 days after delivery date of the Appliance.
- Delays to a Patient’s wear schedule after products are shipped do not extend the limited warranty period.If any KRSTL Product fails to conform to the limited warranty then our sole liability, at our discretion, shall be to credit. If we elect to replace such Product or Appliance, replacements will be provided based on your account status.
- Replace such Product or Appliance.
- Credit your account for the cost paid for such Product or Appliance.
- They supersede any and all prior negotiations, correspondence, understandings and agreements between the Parties regarding the subject matter.
You may be required to return the Product or Appliance in order to receive a replacement or credit. If we elect to replace such Product or Appliance, replacements will be provided based on your account status.
ENTIRE AGREEMENT AND AMENDMENT
These Terms and Conditions, your prescription, and the Patient Informed Consent Form constitute and contain the entire agreement between the Parties.
Terms and Conditions can only be made by an authorized representative of KRSTL.
